3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By registering, you represent that you meet these requirements.

3.2 Account Information

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or security breach

3.3 Account Responsibility

You are responsible for all activities that occur under your account. You may not share your account credentials with others or allow others to access your account.

4. Subscription and Payment

4.1 Subscription Plans

TakaWala offers various subscription plans including trial periods, monthly, and yearly subscriptions. Pricing and plan features are available on our website.

4.2 Payment Terms

• Billing Cycle: Subscriptions are billed in advance on a recurring basis
• Payment Methods: We accept payments via Stripe
• Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date
• Taxes: Prices exclude applicable taxes unless stated otherwise

4.3 Refunds

Refunds are handled on a case-by-case basis. Generally, subscription fees are non-refundable. Contact our support team for refund requests.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.

5. User Responsibilities

You retain all ownership rights to the data you submit to TakaWala. We claim no intellectual property rights over the content you provide.

6.2 Limited License

By using our service, you grant TakaWala a limited license to use, store, and process your data solely for the purpose of providing the service to you.

6.3 Backup and Recovery

We perform regular automated backups of your data. However, you are responsible for maintaining your own backups of critical data.

7. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the service. Scheduled maintenance and unforeseen technical issues may temporarily affect service availability.

We reserve the right to:

• Modify or discontinue the service with reasonable notice
• Suspend service for maintenance or security reasons
• Update features and functionality

8. Intellectual Property

TakaWala and its original content, features, and functionality are owned by Alien Affairs Sp. z o.o. and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our software or content
• Reverse engineer or attempt to extract source code
• Remove or alter any copyright notices
• Use our trademarks without written permission

9. Third-Party Services

TakaWala integrates with third-party services including:

• Google OAuth: For authentication
• Stripe: For payment processing

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation
• Freedom from viruses or harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKAWALA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Errors or inaccuracies in the service

Our total liability to you for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless TakaWala, Alien Affairs Sp. z o.o., and our affiliates from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Your data or content

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting support or using the account closure feature in your dashboard.

13.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• Your account has been inactive for extended periods
• We detect fraudulent or suspicious activity
• Required by law

13.3 Effect of Termination

Upon termination, your right to use the service ceases immediately. We may delete your data after a retention period. You may request data export before termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes shall be resolved in the courts of Warsaw, Poland.

15. Changes to Service and Terms

We reserve the right to modify or discontinue the service at any time with or without notice. We will notify users of significant changes via email or through the service.

Continued use of the service after changes constitutes acceptance of the modified Terms.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and TakaWala regarding the service.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
